DEFENDANT'S MOTION TO WITHDRAW COUNTERCLAIM

 

Folks, if you are involved in a custody modification action a counterclaim is not legal and there is a statutory requirement to file a separate action and serve the other party.

If your attorney has answered and counterclaimed you might want to fire your attorney because you will get sandbagged during trial when your opponent moves to dismiss your case for failure to state a claim and the judge agrees that you did not properly ask for custody of your child.

Please follow our suggestion that you file a motion for mediation and work out a joint parenting agreement with your Ex for the benefit of your child.
